Terms of Service
The agreement between you and EyeFlow for use of our AI video analytics service.
Last updated: 19 May 2026
Draft — this is a working draft and must be reviewed and approved by qualified legal counsel before it is relied on in production. It does not yet constitute final legal terms.
1. Agreement to these terms
These Terms of Service (“Terms”) govern your access to and use of the EyeFlow website, dashboard, and edge software (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business.
If you do not agree to these Terms, do not use the Service.
2. The Service
EyeFlow provides AI-powered video analytics that turns existing IP cameras into a source of operational insight — for example queue, occupancy, safety, and hygiene analytics. The Service includes cloud software, a dashboard, and edge software installed at your locations.
We may improve, change, or discontinue features. We will give reasonable notice of material changes that reduce core functionality.
3. Accounts and security
You must provide accurate registration information and keep it current. You are responsible for all activity under your account and for keeping credentials confidential. Tell us promptly if you suspect unauthorised access.
4. Acceptable use and your responsibilities as data controller
You may use the Service only for lawful purposes and in line with these Terms. You must not misuse the Service, attempt to break its security, reverse engineer it except where the law allows, or use it to infringe anyone’s rights.
Because the Service processes video — and, depending on the modules you enable, biometric and facial data — you are the data controller for that data. You are responsible for: having a valid legal basis for the processing; displaying any required notices and signage at monitored premises; obtaining any consent your local law requires; and complying with all applicable privacy and biometric laws.
You must not enable facial-recognition or person-identification features where doing so is unlawful in the relevant jurisdiction. EyeFlow provides tools; you are responsible for lawful use.
5. Your data
You keep all rights in the data you and your cameras generate (“Customer Data”). You grant EyeFlow a limited licence to host and process Customer Data only to provide and support the Service, as set out in our Privacy Policy and Data Processing Agreement.
We do not use Customer Data — including video and biometric data — to train shared or third-party AI models without your separate, explicit agreement.
6. Plans, billing, and trials
Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. Fees, billing period, and any trial terms are shown at sign-up or in your order.
Unless stated otherwise, fees are non-refundable for the current billing period. We may change pricing with reasonable advance notice that takes effect at your next renewal. Late or failed payment may lead to suspension of the Service.
7. Beta and pre-release features
Parts of the Service may be offered as beta or early-access features. These are provided “as is”, may change or be withdrawn, and may be less reliable than generally available features. Do not rely on beta features for critical operations.
8. Intellectual property
EyeFlow and its licensors own all rights in the Service, including its software, models, and design. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. They do not transfer any ownership to you.
9. Disclaimers and limitation of liability
The Service helps you monitor and analyse your premises, but it does not guarantee detection of every event and is not a substitute for staff judgement, physical security, or emergency services. To the maximum extent permitted by law, the Service is provided “as is” without warranties of any kind.
To the maximum extent permitted by law, EyeFlow is not liable for indirect, incidental, or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the fees you paid for the Service in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.
10. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you materially breach these Terms, fail to pay, or use the Service unlawfully.
After termination, you can export Customer Data for a limited period, after which we delete or anonymise it in line with our Privacy Policy and any Data Processing Agreement.
11. Governing law
These Terms are governed by the law of the jurisdiction stated in your order or, if none is stated, the jurisdiction in which EyeFlow is established. Mandatory consumer-protection rights in your country of residence are not affected. The specific governing law and venue will be confirmed before general availability.
12. Contact and changes
We may update these Terms. We will post the new version here and update the date above, and give reasonable notice of material changes. Continued use after changes take effect means you accept the updated Terms.
